Data Usage Transparency

 

When you engage with John Burnett’s Game UI Design Mentorship Program, we may collect the following information:

  • Email Address: We collect your email address to communicate with you about the project, including payments, scheduling, updates, access to resources, and general correspondence related to your participation.
  • Full Name: We collect your full name to identify you and personalize our communication with you.
  • Location and Time Zone: We collect your location and time zone to facilitate scheduling and better understand your context for communication and participation.
  • Links (Portfolios or Related Sites):  We may collect links to your portfolio or other related sites if you choose to provide them. This information helps us understand your background, skills, and experience, allowing us to better tailor our services or interactions to your specific needs, and may also be used to assess your eligibility for certain programs or opportunities outside of John Burnett’s Game UI Design Mentorship Program.
  • “Understanding You” Section (Qualitative Data): We may collect the information you provide in response to our ‘Understanding You’ part 2 of 2 of our application. This opt-in qualitative data helps us understand your goals, interests, and background, allowing us to personalize your experience and provide more relevant support. Providing this information is entirely optional.

 

Data Retention: We retain your personal information for the duration of your engagement with John Burnett’s Game UI Design Mentorship Program and indefinitely thereafter for record-keeping & administrative purposes including maintaining records of your participation, providing ongoing access to resources (unless you request deletion), and complying with legal and tax obligations.

 

Children’s Privacy: Our services are not intended for children under the age of 18. We do not knowingly collect personal information from children under this age

 

User Rights: You have the right to access, correct, or delete your personal information. To exercise these rights, please contact us at hello@thewingless.com with your specific request. If you wish to delete your data, please specify what information you would like deleted. We will respond to your request within 7 business days. 

 

Updates to this Data Usage Policy: We may update this Data Usage policy from time to time. Any changes will be posted on the mentorship page on the www.thewingless.com site.

This Privacy Policy describes how John Burnett’s Game UI Design Mentorship Program (“we,” “us,” or “our”) collects, uses, and protects your personal information when you engage with our services. We are committed to protecting your privacy and complying with applicable data privacy laws, including GDPR & CCPA.

As described in our Data Usage Transparency section, we may collect the following information:

  • Email Address
  • Full Name
  • Location and Time Zone
  • Links (Portfolios or Related Sites) (Optional)
  • “Understanding You” (Qualitative Data) (Optional)

We use your information for the purposes described in our Data Usage Transparency section, including:

  • Communication related to the project (payments, scheduling, updates, resources, correspondence).
  • Personalizing your experience.
  • Assessing eligibility for programs or opportunities.

  1. How We Protect Your Information:

We take reasonable measures to protect your personal information from unauthorized access, use, or disclosure. These measures include industry-standard encryption for data in transit (HTTPS) and at rest. We store email addresses on secure servers and on personal devices which are protected by standard password protection. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. 

 

  1. Sharing Your Information:

We will not share your personal information with any third parties except as follows:

  • Service Providers: We may share your information with trusted service providers who assist us in operating our business, such as our Payment Processors (Paypal). These service providers are contractually obligated to protect your information and only use it for the purposes we specify.  
  • Legal Compliance: We may disclose your information if required by law or legal process.  

 

  1. Cookies and Tracking Technologies: We use Google Analytics to analyze website traffic and understand how visitors use our site. Google Analytics uses cookies to collect anonymous information about your visit, including which pages you view and how long you stay on each page. This information helps us improve our website and user experience.

 

  1. International Data Transfers: We utilize commonly used online services, such as Google Workspace (including Calendar, Sheets, and Forms) and DreamHost for website hosting. While we take reasonable steps to protect your data, it is possible that your information may be stored or processed on servers located outside of The United States of America. We encourage you to review the privacy policies of these service providers for more information about their data handling practices.

 

  1. Your Rights: We respect your privacy and are committed to complying with applicable data privacy laws, including GDPR and CCPA. Terms of Service

 

  1. Introduction.

These Terms of Service (“Terms”) govern your access to and use of John Burnett’s Game UI Design Mentorship Program (the “Program”) provided by John Burnett (“we,” “us,” or “our”). By accessing or using the Program, you (“you” or “Student”) agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Program.

 

  1. Description of the Program.

The Program is a one-on-one mentorship program designed to help aspiring game UI designers improve their skills and build their portfolios. The Program includes weekly 1-hour video calls with John Burnett, access to email correspondences, and personalized feedback on your work. The specific content and structure of the mentorship may be tailored to your individual skills, needs and goals. 

Upon completion of the Program, students will receive a certificate of completion from John Burnett’s Game UI Design Mentorship Program. This certificate acknowledges participation in the program and is not a guarantee of industry certification or recognition.

The Program provides mentorship and guidance to improve game UI design skills but does not guarantee employment or any specific career outcome. The Program focuses on creative expression, design skill growth, portfolio development and industry best practices.  The Program does not include instruction in specific tools (i.e. Unreal, Unity), job placement services, guaranteed income potential, or promises of employment in the entertainment industry.

The Program is not intended for children under the age of 18. We do not knowingly collect personal information from children under 18.

 

  1. Payment Terms.

 

Program Fee: The Game UI Design Mentorship Program requires a one-time fee of $3997 USD. This fee covers your full participation in the standard 8-week program, which includes one (1) sixty-minute (1-hour) live session per week for a total of eight (8) hours of instruction over the program duration. 

 

Time Management

 

Rescheduling Policy: You are permitted a default of **three (3) reschedules** over the duration of your program. To use a reschedule, you must provide notice at least 24 hours before your scheduled session time. If you are late for a session by more than fifteen (15) minutes without prior notice, it will be considered a missed session and will automatically count as one of your allowed reschedules. If you miss a scheduled session without providing the required notice, it will also count as one of your allowed reschedules. 

Using Reschedules: When a reschedule is used, your scheduled session will be moved to the next week. 

Consequence of No Reschedules Left: If you have used all of your allowed reschedules and miss a scheduled session for any reason other than an extraordinary circumstance (as determined by the mentor’s best judgment), that session will be forfeited and will not be rescheduled or refunded. 

Mentor Rescheduling: If the Mentor can not make the scheduled session, you will not lose any of your Rescheduling days, and we will move the session to the next week.

Extraordinary Circumstances: In rare cases of extraordinary circumstances affecting either the student or the mentor, the mentor will use their best judgment regarding rescheduling outside of the standard policy. 

 

Payments.

Payment Processing: We use Paypal to process all payments securely. By enrolling, you agree to provide accurate and complete payment information and authorize us to charge your chosen payment method for the Program fee and any subsequently purchased additional time fees.

Providing Accurate Payment Information: You agree to provide current, complete, and accurate payment information. You agree to promptly update your account and payment information as necessary.

Buy Now Pay Later: BNPL is only available to students with a PayPal account in good standing. PayPal runs a soft credit check and will adjust its monthly cost based thusly. Any complications that arise from BNPL must be addressed to Paypal.

 

  1. Refunds & Cancellation.

 

Initial Commitment & Prorated Refund: The Program requires an initial two-month commitment. If you are not satisfied after the third Session but before the Fourth, you are entitled to a prorated refund for any unused session. Contact us at hello@thewingless.com explaining your concerns. The prorated refund will be calculated as follows: (Total Cost of 8 sessions / 8 total sessions) * Number of Remaining Sessions. No refunds are available after the fourth Session (the halfway mark) for the remaining portion of the initial two-month commitment.

Exceptional Circumstances: In extremely rare and truly exceptional circumstances (e.g., death in the immediate family, unexpected job loss, or serious illness), we may consider a partial or full refund. Requests must be made in writing to hello@thewingless.com with supporting documentation. These refunds are at our sole discretion.

Termination: We may terminate or suspend your access immediately, without notice or liability, for any reason, including breach of these Terms.

 

  1. Intellectual Property.

Student’s Work: You retain ownership of any UI designs or other work you create during the Program.

Our Materials: We retain ownership of all training materials, resources, and intellectual property provided as part of the Program. You may not reproduce, distribute, or modify these materials without our express written consent.

Use of Student Work for Promotional Purposes: You agree that we may use any and all work created by you during the Program, including but not limited to UI designs, sketches, wireframes, portfolio projects, and testimonials, in our promotional materials. These materials may include website content, marketing materials, social media posts, and advertisements. You retain ownership of your work, but you grant us a non-exclusive, royalty-free, worldwide license to use it. If you do not wish to have your work used in promotional materials, you must provide written notice to us at hello@thewingless.com before the start of the Program.

 

  1. Code of Conduct.

Communication: As part of the Program, you are entitled to at least one email correspondence with us per week. We aim to respond to your emails promptly, typically within 3 business days, but we cannot guarantee immediate responses. While we encourage regular communication, excessive or unreasonable email frequency (defined as more than three emails per week without prior agreement) may be considered a breach of these Terms. In such cases, especially with regards to harassment, we reserve the right to limit or suspend further email communication and take any other actions available to us under these Terms, including the termination of your access to the Program. 

Behavior: You agree to conduct yourself professionally and respectfully during the Program. You agree not to:

  • Engage in any harassment, discrimination, or other inappropriate behavior.
  • Use the Program for any illegal or unauthorized purpose.
  • Violate any applicable laws or regulations.
  • Plagiarism or unauthorized distribution of the Program’s educational modules, literature, blogs or other associated documentation.

We reserve the right to terminate your access to the Program for any violation of this Code of Conduct.

 

  1. Disclaimer.

The Program is provided “as is” and without any warranty of any kind, express or implied. We do not guarantee that the Program will meet your specific needs or that you will achieve any particular results. Your participation in the Program is at your sole risk.

 

  1. Limitation of Liability.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Program; (ii) any conduct or content of any third party on the Program; (iii) any content obtained from the Program; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.  

 

  1. Dispute Resolution.

Any dispute arising out of or relating to these Terms or the Program shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall be conducted in Illinois, United States of America. Each party shall be responsible for their own legal fees. The costs of the arbitration, including filing fees and arbitrator fees, shall be shared equally by the parties. The decision of the arbitrator shall be final and binding on both parties. 

 

  1. Governing Law.

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.  

 

  1. Entire Agreement.

These Terms constitute the entire agreement between you and us relating to the Program and supersede all prior or contemporaneous communications and proposals, whether oral or written.
